In these terms, “Management” means Miami Vacations Corporate Rentals Corp and its trade names, owners, officers, members, managers, employees, agents and authorized representatives, insurers, successors and assigns.
- Release of negligence claims. To the fullest extent permitted by Florida law, guests release Management from all claims for injury, death or property loss arising from the stay, including claims caused by Management’s own ordinary negligence. This release does not apply to gross negligence or intentional misconduct.
- Assumption of risk. Guests assume the inherent and open risks of a high-rise vacation stay, including wet floors, stairs and glass doors.
- Balcony, pool, common areas, beach and ocean. Guests assume the inherent risks of these areas. No lifeguard is on duty unless posted. Children may never be on the balcony unattended. Section 1 applies.
- Hazard and injury reporting. Guests must report unsafe conditions and injuries to Management promptly, within 24 hours where possible. Failure to report may be considered in assessing comparative fault.
- No tampering. Guests may not adjust doors, railings, glass, alarms or fixtures. Injuries caused by tampering are the guest’s responsibility.
- Minors. Guests must supervise minors at all times. A parent or guardian must sign a separate minor release in the form required by Florida Statute §744.301(3).
- Entry and relocation. Management may enter with reasonable notice, or immediately in an emergency. If relocation is needed for safety, Management will provide comparable lodging or refund the unused nights.
- Indemnification. Guests will indemnify Management for claims, losses and attorneys’ fees caused by the guest’s or their visitors’ misuse, rule violations or negligence.
- Limitation of liability. If any release in these terms is held unenforceable, Management’s total liability for ordinary negligence is limited to the amount stated in the signed Agreement. This limit does not apply to gross negligence or intentional misconduct.
- Comparative fault. Florida’s comparative fault law (Florida Statute §768.81) applies to any claim.
- Medical emergencies and incidents. Management will offer to call 911 for any injury, and any refusal will be documented. Guests agree to cooperate with incident reports.
- Service animals. Only ADA-defined service animals are permitted. Misrepresenting a service animal violates Florida Statute §413.08 and is grounds for removal without refund.
- Arbitration, jury and class action waiver. Any dispute arising from these terms or the stay will be resolved by binding individual arbitration in Miami-Dade County under the Federal Arbitration Act, administered by the American Arbitration Association under its Consumer Rules. Either party may instead bring an individual claim in small claims court. Guests waive the right to a jury trial and to bring or join a class action.
- Attorneys’ fees. The prevailing party in any dispute recovers reasonable attorneys’ fees and costs.
- Severability. If any part of these terms is held unenforceable, it will be limited to the minimum extent necessary and the rest stays in full effect.
